ELIGIBILITY. The Windstar Cruises Enter to Win Drawing (the “Drawing”) is only open to residents of the United States, and who are 18 years of age or older at time of entry. Void where prohibited by law. Employees of Windstar Cruises Marshall Islands, LLC (“Sponsor”), Xanterra Leisure Holding, LLC, Anschutz Entertainment Group, Inc., and their respective affiliates, owners, subsidiaries, advertising or promotion agencies are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse, and life partners). Proof of residency and age may be required.
TIMING. The Drawing begins at noon Pacific Daylight Time (“PDT”) on April 18, 2025 and ends at noon PDT on May 9, 2025 (“Promotion Period”). Entries received prior to or after the Promotion Period are disqualified. The Clock of the Sponsor will be the official timekeeper for this Drawing.
PROMOTION PERIOD/HOW TO ENTER. You can enter the Drawing between noon Pacific Daylight Time (“PDT”) on April 18, 2025 and noon PDT on May 9, 2025 (the “Promotion Period”). To enter, entrant must visit URL www.windstarcruises.com/welcomeLA during the Promotion Period and follow the instructions on the screen. Entrant must complete the online survey and all required information in order to be eligible. If you do not wish to enter online and complete the survey, Drawing can also be entered via mail by sending a postcard with your full name, age, e-mail address, residential address, phone number and date of entry to: “2025 Windstar Cruises Drawing” c/o Marketing Department, 8400 NW 36th Street, Suite 520, Miami, FL 33166. One entry per person. One entry per e-mail address. All entries become the exclusive property of Sponsor and will not be acknowledged or returned Sponsor, Xanterra Leisure Holding, LLC, and Anschutz Entertainment Group, Inc. are not responsible for lost, late, incomplete, garbled, illegible, misdirected, damaged, incomplete, or postage-due Drawing entries, or for any error, human, technical or otherwise, which may occur in the processing of Drawing entries. Proof of sending or submission will not be deemed to be proof of receipt. All entries become the exclusive property of Sponsor and will not be acknowledged or returned. Any use of robotic, automatic, mechanical, programmed or similar entry methods will void all such entries by such methods. Any person who attempts to participate using multiple email or street addresses or under multiple identities or uses any device or artifice to enter online multiple times will be disqualified.
USE OF DATA. Sponsor will be collecting personal data about participants (including, without limitation, name, phone number, mailing address, gender, age e-mail addresses) when they enter the Drawing online. Sponsor and its affiliates, agents and marketers are entitled to use personal data contained in all entry forms, on-line or otherwise, in accordance with the Sponsor’s Privacy Policy located at: https://www.xanterra.com/privacy-policy/ and Terms of Use located at https://www.windstarcruises.com/terms-of-use  (both of which are incorporated herein by reference). By participating in the Drawing, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s Privacy Policy and Terms of Use. Furthermore, personal data may be shared with Xanterra Leisure Holding, LLC, and, by participating, entrants agree that such data will be used in accordance with the terms and conditions of Xanterra’s Privacy Policy at https://www.xanterra.com/privacy-policy/  (both of which are incorporated herein by reference). Participants will be given the option to receive commercial e-mails and promotional materials from Sponsor, Xanterra Leisure Holding, LLC and/or Anschutz Entertainment Group, Inc., however, eligibility to participate in the Drawing is not dependent upon participant’s consent to receive such e-mails and promotional materials and consenting to do so will not increase your chances of winning.
AGREEMENT TO OFFICIAL RULES. Participation in the Drawing constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and Sponsor's Privacy Policy and Term of Use, as well as Xanterra’s Privacy Policy and Terms of Use and to be contacted by telephone and/or email. Sponsor’s failure or delay to enforce any term of these Official Rules shall not constitute a waiver of that term.
SELECTION OF POTENTIAL WINNER. One (1) winner will be selected by a random drawing on or about May 16, 2025 (the “Winner”). Winner will be notified via telephone or email (as determined by Sponsor in its sole determination) on or about May 16, 2025. Sponsor's decisions as to all matters related to administration of the Drawing and selection of the Winner is final and binding. Potential Winner and all guests must comply with all terms and conditions set forth in these Official Rules and winning and award of Prize is contingent upon fulfilling all requirements. If a potential winner cannot be contacted by Sponsor within twenty-four (24) hours of the first attempt to contact such potential winner, or if the potential winner cannot or will not accept the prize, the prize will be forfeited and an alternate potential winner may be randomly selected from among all remaining eligible entries.
PRIZE: One (1) prize will be awarded in all. Winner will receive the following prize package: an All-Inclusive 7-Day Cruise to Tahiti on the Windstar Star Breeze (for use by Winner and one (1) guest (the “Prize”). All-inclusive package includes the following: (i) ocean view room; (ii) food and unlimited select beer, wine and cocktails (iii) Unlimited Wi-Fi package (iv) crew gratuities; (Blackout dates and other restrictions may apply. Must sail by December 11, 2025). Trip subject to availability. Prize does not include shore excursions, transportation, airfare, laundry services, spa services, or any additional incidentals or expenses purchased onboard Total Approximate Retail Value (“ARV”) of Prize: $8,400.00). Difference between actual value and stated value will not be awarded. Odds of winning depend on the number of eligible entries received during the entire Promotion Period. Winner’s Guest (as defined above) must be of legal age of majority in their jurisdiction of residence and at least 18 years of age or older. Winner and guest must travel on same itinerary.
Prize (and/or any portion thereof), is nontransferable and non-exchangeable. No substitutions or cash redemption of Prize is permitted, except that Sponsor reserves the right to substitute the Prize (or portion thereof) with one of comparable or greater retail value, at its sole and absolute discretion (or at Sponsor's election, the cash value of the applicable prize). Additional restrictions may apply.
Winner, Guest, and all other guests of Winner agree to comply with all applicable arena and/or other destination rules and/or regulations in connection with the Prize, including, without limitation, any rules or regulations relating to COVID-19, and the execution of a general release as may be required for use of the Prize. Sponsor reserves the right to remove or deny entry to Winner, Guest or all other guests of Winner, who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person during and while participating on the 7-Day Cruise. Releasees (as defined below) will not be responsible for weather, acts of God, natural disasters, acts of terrorism, civil disturbances, work stoppages, epidemics or pandemics, or any other similar event beyond Sponsor’s reasonable control that may cause the cancellation or postponement of any game or the closure of any Prize destination.
All federal, state and local taxes related to the Prize are the sole responsibility of the Winner. All other expenses and costs not expressly listed above are the Winner's sole responsibility. No refunds or credit for changes are allowed. No transfer of the Prize is permitted. The Winner must execute and return an Affidavit of Eligibility/Release of Liability, and, except where prohibited by law, Publicity and a W-9 within five (5) days of receipt from Sponsor. Winner’s Guest will also be required to execute an Affidavit of Eligibility/Release of Liability, and, except where prohibited by law, Publicity within five (5) of receipt. Noncompliance within this time period may result in disqualification, and an alternate winner may be selected. Return of any Prize notification as undeliverable may result in disqualification and selection of an alternate winner.
GENERAL CONDITIONS. The Drawing is governed by the laws of the United States and the State of California, excluding conflicts of laws principles. All federal, state and local laws and regulations apply. Drawing void where prohibited.

Except where prohibited by law, the Winner grants to Sponsor and each of their respective designees the right to use and publish the Winner's photo, proper name, likeness, voice, opinions, quotes, biographical information and state in any media to promote the Drawing without additional compensation. The Winner agrees that Winner’s Guest shall be required to do the same.
Submission of any contact information in connection with this Drawing, including, without limitation, name, mailing address, cell phone number, and/or email address, constitutes permission for Sponsor, and its respective directors, officers, employees, agents and assigns to use entrant’s personal information for purposes of administration of the Drawing. Participants may be given the option to receive commercial e-mails from Sponsor, however, eligibility to participate in the Drawing is not dependent upon entrant’s consent to receive such e-mails and consenting to do so will not increase your chances of winning. Participants may opt-out of receiving such communications as set forth in Sponsor’s Privacy Policy and Terms of Service or as provided within any such marketing materials (e.g. using the “Unsubscribe” feature provided in the footer of Sponsor’s e-mails). Participants understand that they are providing their information to Sponsor. The information participants provide to Sponsor will only be used in accordance with Sponsor’s Privacy Policy and Terms of Service.
By entering, participants release, indemnify and hold harmless Sponsor, Xanterra Leisure Holding, LLC, Anschutz Entertainment Group, Inc., and each of their respective subsidiaries, affiliates, owners, advertising and promotion agencies, members, shareholders, directors, officers, employees and agents (each a “Releasee” and collectively, the “Releasees”) from any and all claims and liability for any injuries, illness, death, loss or damage of any kind, including, without limitation, from acceptance, use or misuse of a Prize, participation, or inability to participate in the Drawing or any exposure to COVID 19 or any variant (collectively, “COVID-19), arising from or in connection with participation in the Drawing, or the receipt, or use and/or misuse of any Prize.
By accepting the Prize, Winner, Guest and all other guests of Winner, voluntarily assume all risks related to exposure to COVID-19 and acknowledge and agree: (i) that the hazards and risks associated with COVID-19 cannot be fully eliminated; (ii) that Winner, Guest and all other guests of Winner shall indemnify and hold harmless the Releasees from all claims arising from or out of, or relating to, directly or indirectly, COVID-19 or any other illness or injury that may incur from use of the Prize, whether caused by the negligence of Winner, any guest of Winner, including without limitation, the Guest, any Releasee or other third party; (iii) to hereby forever release, waive, discharge and covenant not to sue the Releasees for any claims associated with COVID-19; and (iv) that Releasees shall not be responsible for any claims arising from or out of, or relating to, directly or indirectly, COVID-19 or any other illness or injury that may be incurred by receipt or use of the Prize, whether caused by the negligence of Winner, any guest of Winner, including, without limitation, the Guest, any Releasee, or any third party, and the Releasees accept no liability for such claims.
Sponsor reserves the right to cancel or modify the Drawing if it is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, technical failures fraud or any other factor or causes which Sponsor deems impairs, corrupts or affects the integrity, administration, security, fairness or proper conduct of the Drawing as determined by Sponsor in its sole discretion.
Online entries are deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and is a California resident. Prize will only be awarded to the authorized account holder.
If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Drawing, or if technical difficulties compromise the integrity of the Drawing, Sponsor reserves the right in its sole discretion to void any entries at issue (including disqualifying any individual who tampers or otherwise interferes with the entry process), and to cancel, terminate, modify or suspend the Drawing, in whole or in part, at any time by posting a notice at http://www.windstarcruises.com/welcomeLA. In the event of such cancellation, Sponsor reserves the right to award prize in a random drawing from all eligible entries received before the time of cancellation.
Sponsor in no way promotes illegal acts, and any and all entries which include or promote illegal acts will be disqualified. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction of unauthorized access to, or alternation of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry received by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Drawing.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE DRAWING MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
This Drawing is governed by the laws of the United States of America and California, without respect to conflict of law doctrines. As a condition of participating in this Drawing, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Drawing, shall be resolved individually, without resort to any form of class action, exclusively before a court, and not a jury, located in Los Angeles County, California that is hereby agreed to have jurisdiction. Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and hereby waives all rights to claim indirect, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses, and entrant further waives all rights to have damages multiplied or increased.
